Banned outfit suspects acquitted |

An additional district and sessions judge (ADSJ) acquitted two suspects allegedly belonging to a banned outfit for want of evidence.
Qasim Toori and Mohammed Danish alias Talha were produced before ADSJ Obaid Ahmed Khan inside Judicial Complex amidst tight security on Monday.
The court pronounced its verdict after hearing both the sides and came to the conclusion that no material evidence was produced against them. The judge ordered their release if they were not wanted in any other case.
Qasim Toori and Mohammed Danish were arrested by the Shah Faisal police after an encounter in January 30, 2008 for allegedly robbing Rs 0.8 million from PICIC Bank. The police registered FIR No. 263/08 under Section 395 of the Pakistan Penal Code on the complaint of bank manager Naseer Ahmed.
The prosecution failed to produce any witnesses or any evidence against them. Gang rape case: A prosecution witness - lady medico-legal officer (MLO) - failed to substantiate her final report that she submitted in the court of Additional District and Sessions Judge regarding the gang rape of an 18-year-old woman from Lodhran.
She presented her report on the basis of DNA report and did not write her own observations for which she had to face embarrassment as the judge came hard on her for merely relying on laboratory report. When the hearing resumed on Monday Dr Rohina submitted her report based on the DNA report which corroborated that the rape was committed.
However, the judge came hard on her as she failed to mention the date in her report and left most of the columns blank. It was also not mentioned as to whether it was rape or abduction as the column was left blank.
ADJ East Sanaullah Ghori expressed his annoyance as no work was done by the MLO and she merely relied on the DNA report. When the defence lawyer M.R Syed asked her as to whether she verified the DNA report submitted by the laboratory, she replied in negative, saying that she was not aware of the case property as to whether it was sealed or open.
The judge asked her as to how she submitted final report of the case without going into details. Three accused Khadim Hussain, Raja Arif and Arif Ansari, all employees of the Quaid’s mausoleum, were also present in the court. After hearing the prosecution witness, the judge adjourned the hearing till February 15.
Razia Kubra, 18-year-old woman from Lodhran, was gang raped inside Quaid’s mausoleum allegedly by mausoleum employees on March 9, 2008. An FIR was registered by the Brigade police station under Section 365-B of the Pakistan Penal Code (the section was inserted through the Protection of Women Act-2006) on the complaint of her father. |
