A Sindh High Court (SHC) division bench, comprising Justice Dr Rana M. Shamim and Justice Ghulam Dastagir A. Shahani, dismissed two appeals in narcotics case while modifying the amount of fine and sentence in case of default. The first appeal was filed by a Ghanaian national Jaffer Johri Shafeh who was arrested at the Jinnah Terminal Karachi. The Anti Narcotics Force (ANF) had recovered 66 heroin-filled capsules weighing 750 grams from his body cavity. The accused/appellant was tried and convicted by the Control for Narcotics Substances Court. He was sentenced 30 months of imprisonment and a fine of Rs40,000. The appellate bench, after hearing the appeal of the accused, upheld his prison term but reduced the amount of fine to Rs20,000 and in case of default he would have to serve a one month term. The same bench, deciding another appeal, upheld the sentence awarded to a convict/appellant Najeeb. The ANF had recovered 50 capsules (containing 450 grams of heroin powder) from his body cavity. He was convicted and sentenced to a two-year jail term and a fine of Rs30,000. Considering the mitigating circumstances of the convict/appellant the bench maintained his prison term but reduced the amount of fine to Rs5,000 and in case of default he would have to serve one month in prison. |
